("AUP") and ("TOS")

 

This AUP governs the use of BeanTown Host's web hosting service.  Violation of this AUP may result in suspension or termination of your service.  In the event of a dispute between you and BeanTown Host regarding the interpretation of this AUP, BeanTown Host's interpretation, in its reasonable commercial judgment, shall govern.  If you have any questions regarding this AUP, contact support@cyberbite.com.

BeanTown Host guarantees 99.9% uptime for all services with the exceptions:

  • scheduled maintenance;
  • network outages caused by upstream network providers;
  • outages caused by the customer;

 

30 Day Money Back Policy

Upon request we will cancel your service and refund 100% of your money, except in the following circumstances:

  • dedicated servers and colocation are not eligible;
  • managed services, web design and custom programming are not eligible;
  • domain names and ssl certificates are not eligible;

Content "published or transmitted" via BeanTown Host's service includes Web content, e-mail, bulletin board postings, chat, a nd any other type of posting or transmission that relies on any Internet service provided by BeanTown Host.

  • IRC Scripts/Bots
  • Proxy Scripts/Anonymizers
  • Pirated Software/Warez
  • Image Hosting Scripts (similar to Photobucket or Tinypic)
  • AutoSurf/PTC/PTS/PPC sites
  • IP Scanners
  • Bruteforce Programs/Scripts/Applications
  • Mail Bombers/Spam Scripts
  • Banner-Ad services (commercial banner ad rotation)
  • File Dump/Mirror Scripts (similar to rapidshare)
  • Commercial Audio Streaming (more than one or two streams)
  • Escrow/Bank Debentures
  • High-Yield Interest Programs (HYIP) or Related Sites
  • Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
  • Sale of any controlled substance without prior proof of appropriate permit(s)
  • Prime Banks Programs
  • Lottery Sites
  • MUDs/RPGs/PBBGs
  • Hateful/Racist/Harassment oriented sites

Offensive Content

You may not publish or transmit via BeanTown Host's service any content that BeanTown Host reasonably believes:

  • constitutes child pornography;
  • constitutes pornography;
  • is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech;
  • is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes; 
  • is defamatory or violates a person's privacy;
  • creates a risk to a person's safety or health, creates a risk to public safety or health, compromises national security,  or interferes with a investigation by law enforcement;
  • improperly exposes trade secrets or other confidential or proprietary information of another person;
  • is intended to assist others in defeating technical copyright protections;
  • clearly infringes on another person's trade or service mark, patent, or other property right;
  • promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking;
  • is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to BeanTown Host; or
  • is otherwise malicious, fraudulent, or may result in retaliation against BeanTown Host by offended viewers.

Content "published or transmitted" via BeanTown Host's service includes Web content, e-mail, bulletin board postings, chat, and any other type of posting or transmission that relies on any Internet service provided by BeanTown Host. 

 

Resource Usage

Users may not:

  • Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
  • At least 75% of files in your account must be linked to other pages on your site, you may not use your account for a backup service
  • Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
  • Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
  • Run any software that interfaces with an IRC (Internet Relay Chat) network.
  • Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our shared servers.
  • Participate in any file-sharing/peer-to-peer activities
  • Run any gaming servers such as counter-strike, half-life, battlefield1942, etc
  • Run cron entries with intervals of less than 15 minutes When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include("http://yourdomain.com/include.php") use include("include.php")

INODES (files)
The use of more than 250,000 inodes on any shared account may potentially result in a warning first, and if no action is taken future suspension. Accounts found to be exceeding the 50,000 inode limit will automatically be removed from our backup system to avoid over-usage. Every file (a webpage, image file, email, etc) on your account uses up 1 inode.

Sites that slightly exceed our inode limits are unlikely to be suspended; however, accounts that constantly create and delete large numbers of files on a regular basis, have hundreds of thousands of files, or cause file system damage may be flagged for review and/or suspension. The primary cause of excessive inodes seems to be due to users leaving their catchall address enabled, but never checking their primary account mailbox. Over time, tens of thousands of messages (or more) build up, eventually pushing the account past our inode limit. To disable your default mailbox, login to cPanel and choose "Mail", then "Default Address", "Set Default Address", and then type in: :fail: No such user here.

Backup Limit Any shared account using more than 20 gigs of disk space will be removed from our off site weekly backup with the the exception of Databases continuing to be backed up. All data will continue to be mirrored to a secondary drive which helps protect against data loss in the event of a drive failure.

 

Bandwidth Usage/Overages

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

 

Security

You must take reasonable security precautions.  You must protect the confidentiality of your password, and you should change your password periodically.

 

Bulk Commercial E-Mail

You must obtain BeanTown Host's advance approval for any bulk commercial e-mail, which will not be given unless you are able to demonstrate all of the following to BeanTown Host's reasonable satisfaction:

  • Your intended recipients have given their consent to receive e-mail via some affirmative means, such as an opt-in procedure;
  • Your procedures for soliciting consent include reasonable means to ensure that the person giving consent is the owner of the e-mail address for which the consent is given;
  • You retain evidence of the recipient's consent in a form that may be promptly produced on request, and you honor recipient's and BeanTown Host's requests to produce consent evidence within 72 hours of receipt of the request.
  • The body of the e-mail must describe how the e-mail address was obtained, for example, "You opted in to receive this e-mail promotion from our Web site or from one of our partner sites," and information on how to request evidence of the consent, for example, If you would like to learn more about how we received your e-mail address please contact us at support@cyberbite.com.
  • You have procedures in place that allow a recipient to easily revoke their consent - such as a link in the body of the e-mail, or instructions to reply with the word "Remove" in the subject line.  Revocations of consent are honored within 72 hours, and you notify recipients that their revocation of their consent will be honored in 72 hours;
  • You must post an abuse@cyberbite.com e-mail address on the first page of any Web site associated with the e-mail, you must register that address at abuse.net, and you must promptly respond to messages sent to that address;
  • You must have a Privacy Policy posted for each domain associated with the mailing;
  • You have the means to track anonymous complaints;
  • You may not obscure the source of your e-mail in any manner.  Your e-mail must include the recipients e-mail address in the body of the message or in the "TO" line of the e-mail; and
  • You otherwise comply with the CAN SPAM Act and other applicable law.

These policies apply to messages sent using your BeanTown Host service, or to messages sent from any network by you or any person on your behalf that directly or indirectly refer the recipient to a site hosted via your BeanTown Host service.  In addition, you may not use a third party e-mail service that does not practice similar procedures for all its customers.

BeanTown Host may test and otherwise monitor your compliance with its requirements, including requesting opt-in information from a random sample of your list at any time.

 

Unsolicited E-Mail

You may not send any unsolicited e-mail, either in bulk or individually, to any person who has indicated that they do not wish to receive it.

You must comply with the rules of any other network you access or participate in using your BeanTown Host's services.

 

Material Protected by Copyright

You may not publish, distribute, link to or otherwise copy in any manner any music, software, art, or other work protected by copyright law unless:

  • you have been expressly authorized by the owner of the copyright for the work to copy the work in that manner;
  • you are otherwise permitted by established United States copyright law to copy the work in that manner.

BeanTown Host will terminate the service of repeat copyright infringers.

 

Copyright Infringement Notice (Digital Millennium Copyright Act)

If you believe your copyright is being infringed by a person using the BeanTown Host network, please send your written notice of copyright infringement to:

Your notice must include the following:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted words at a single site are covered by a single notification, a representative list of such works at that site;
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit BeanTown Host to locate the material;
  • Information reasonably sufficient to permit BeanTown Host to contact you, such as an address, telephone number, and, if available, an e-mail address;
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the copyright owner's agent, or the law;
  • A statement that the information in the notification is accurate, and under penalty of perjury that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

 

Other

You must have valid and current information on file with your domain name registrar for any domain hosted on the BeanTown Host network.

 

Disclaimer

BeanTown Host is under no duty, and does not by this AUP undertake a duty, to monitor or police our customers' activities and disclaims any responsibility for any misuse of the BeanTown Host network.

Internet Abuse

You may not engage in illegal, abusive, or irresponsible behavior, including:

  • Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures (including those belonging to BeanTown Host and its customers) without express authorization of the owner of the system or network;
  • monitoring data or traffic on any network or system without the authorization of the owner of the system or network;
  • Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks;
  • Use of an Internet account or computer without the owner's authorization, including, but not limited to Internet scanning (tricking other people into releasing their passwords), password robbery, security hole scanning, and port scanning;
  • Forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting; or
  • Any conduct that is likely to result in retaliation against the BeanTown Host's network.
  • Use of BeanTown Host's network in a way that unreasonably interferes with BeanTown Host's other customers use of the network

 

Terms of Service

  • BeanTown Host has the right to change the price of the services at any time with 30 days notice.;
  • CLIENT agrees to pay a setup fee, a monthly fee, an usage fee (if any), and a web traffic fee (if any). The setup fee and first month fee is due upon sign up. BeanTown Host will present a fee schedule to CLIENT before sign up. BeanTown Host requires a 30 day advanced notice for cancellations of all dedicated services including but not limited to: Colocation, Dedicated Servers, etc.
  • All customers that are 5 days late are subject to a 10% late fee;
  • Accounts past due more than 35 days may be terminated without notice;
  • Restoring files from backup is a $25 fee;
  • Domain names that are not renewed ontime are subject to a reactivation fee which is determined by the registrar;
  • CLIENT has 48 hours from the time service is activated to receive reimbursement if CLIENT cancels, after that BeanTown Host does not reimburse unused prepayments;
  • if CLIENT's account is suspended and CLIENT wishes to have a backup copy of his files, he must bring his account current before any backup files are released.
  • CLIENT's that voilate our policies may be terminated at any time without reimbursement
